Welcome to Social Climber

Thank you for using Social Climber, a social network for bouldering and climbing enthusiasts. These Terms of Service ("Terms") govern your access to and use of the Social Climber mobile applications and any related services ("Service"). By creating an account or using the Service, you agree to be bound by these Terms, as well as our Privacy Policy and Cookie Policy referenced herein. If you do not agree, please do not use the Service.

Eligibility and Account Registration

Minimum Age

You must be at least 13 years old to use Social Climber. If you are under 13, you may not use the Service or provide any personal information to us. Additionally, if you reside in a jurisdiction (for example, in the European Union) that requires a higher minimum age for data processing or use of online services, such as 16 years old in the EU, you must meet that age requirement. By using Social Climber, you represent and warrant that you meet the minimum age requirements.

Minors

If you are between 13 and 18 (or the age of majority in your region), you affirm that you have the consent of your parent or legal guardian to use the Service. We may require parental consent or verification for users under the age of digital consent as mandated by law. We do not knowingly allow children under 13 to create accounts or collect personal information from them without parental consent, in compliance with the U.S. Children's Online Privacy Protection Act (COPPA) and similar laws. If we learn that a user under 13 is using the Service without appropriate permission, we will remove the account and delete any personal data collected.

Account Creation

To access certain features, you need to create an account (for example, via email sign-up or OAuth login through Google, Facebook, etc.). You agree to provide true, accurate, and complete information during registration and to keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Do not share your password or allow others to use your account. If you suspect unauthorized use of your account, notify us immediately.

Account Security

You are responsible for all activity on your account. Social Climber will not be liable for any loss or damage arising from your failure to safeguard your account. Please use a strong password and exercise caution on shared devices.

One Account

You should not create multiple accounts for yourself or create an account for anyone other than yourself without permission. We reserve the right to refuse registration, suspend accounts, or reclaim usernames (e.g. if they are inappropriate or violate someone's rights).

Acceptable Use and Community Guidelines

We aim to foster a friendly and safe community for climbers. By using Social Climber, you agree NOT to engage in any of the following prohibited activities:

We expect you to be respectful to others; if you act inappropriately, we may remove your content or terminate your account. Social Climber reserves the right to review, monitor, moderate, or remove any user content or accounts that violate these rules or for any other reason in our discretion, although we are not obligated to do so. Repeated or serious violations may result in account suspension or termination without prior notice.

User Content and License

Social Climber allows you and other users to create, post, and share content, including text, photos, videos, comments, group posts, event listings, chat messages, and other materials ("User Content"). You retain all ownership rights in the User Content that you create and submit on the Service – what's yours is yours.

However, by submitting or posting User Content on Social Climber, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to use, host, store, reproduce, modify (e.g., reformat or compress files for display), create derivative works of (e.g., translate or caption content), distribute, publicly display and perform your content through the Service and in our marketing materials or social media channels solely for the purpose of operating, developing, providing, and promoting the Service. This license allows us to show your posts to other users (according to the privacy/settings you choose), to feature your content in app screenshots or promotional materials (if you make it public), and to back up or analyze content for service improvement.

Duration of License

This license lasts for as long as your content is protected by intellectual property rights and you have an active account, but it ends when you delete your content or your account, with the exception that we may retain server or backup copies for a limited time and that content may persist to the extent it has been shared with others and they have not deleted it. For example, removing a post will delete it from your profile, but if others have re-shared it or if it was posted in a group, copies may remain visible. We are not required to delete content that has been aggregated or anonymized (so it no longer identifies you).

Your Responsibilities for Content

You are solely responsible for any User Content you create, post, or share. By posting content, you represent and warrant that:

  1. You own or have all necessary rights to the content, and grant us the above license
  2. The content is accurate (where it states facts) and is not confidential or proprietary to a third party
  3. The content and your use of it on the Service comply with these Terms and applicable laws

We do not claim ownership of your content, and nothing in these Terms restricts your rights to use your own content however you like outside of the Service.
